8. Intellectual Property Rights

Our Intellectual Property

• Access Post-Cancellation: Your account will remain accessible until the end of your current billing cycle. Subsequently, your account and all associated data will be permanently deleted.
• Account Deletion: If you decide to delete your account, this action will permanently erase all your data and personal information from our systems, making recovery impossible.

We reserve the right to terminate your service for any breach of this Agreement, including, but not limited to, violations of user conduct, engaging in illegal activities, or failing to pay fees. We will notify you before termination unless an immediate termination is required to protect Dollin.info, its users, or to fulfill legal obligations.

Following any termination, whether initiated by you or us, your access to and use of the service will end immediately, and all billing will cease. At our discretion, you may be granted limited time to retrieve your User Content, in accordance with our data retention policy.

10. Disclaimers and Limitations of Liability

We provide our service on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that the service or the server that makes it available are free of viruses or other harmful components.

To the maximum extent permitted by applicable law, in no event will Dollin.info, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not Dollin.info has been informed of the possibility of such damage.

We reserves the right, at our own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Dollin.info in asserting any available defenses. This indemnification obligation will survive the termination of your service and your use of the Dollin.info service.

12. Governing Law and Dispute Resolution

• Disputes: Before seeking legal recourse, we encourage users to contact us directly to resolve disputes amicably. We prioritize a constructive dialogue to address grievances.
• Governing Law: This Agreement and your use of the Dollin.info service shall be governed by and construed in accordance with the laws of New Zealand, without giving effect to any principles of conflicts of law. • Jurisdiction: You agree that any legal action or proceeding between you and Dollin.info related to this Agreement shall be brought exclusively in the competent courts located in New Zealand. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the courts of New Zealand.

13. General Provisions

• If any provision of this Agreement is held to be invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the remaining provisions of the Agreement will continue in full force and effect.
• The failure of Dollin.info to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Dollin.info.
• You may not assign or transfer these Terms of Service, by operation of law or otherwise, without the prior written consent of Dollin.info. Any attempt by you to assign or transfer these Terms of Service, without such consent, will be null and void. Dollin.info may assign or transfer these Terms of Service, at its sole discretion, without restriction.
• This Agreement constitutes the entire agreement between you and Dollin.info regarding the use of the Dollin.info service, superseding any prior agreements between you and Dollin.info regarding your use of the service.
• Any notices or other communications provided by Dollin.info under this Agreement, including those regarding modifications to this Agreement, will be given: (i) via email; or (ii) by posting on dollin.info. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.
• The headings in this Agreement are for reference only and shall not affect the interpretation of this Agreement.
• Dollin.info shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond the reasonable control of Dollin.info, including, without limitation, mechanical, electronic, or communications failure or degradation.
